1. Agreement to Terms
Welcome to CoverCollect.co (“Company”, “we”, “us”, “our”). These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and CoverCollect.co, concerning your access to and use of the covercollect.co website as well as any other media form, media channel, database repository, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Service, including our separate subscription and refund policies. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, community frameworks, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. The Content and the Marks are provided on the Site “AS IS” for your information and personal research use only. Except as expressly provided in these Terms of Service, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever without our express prior written permission.
3. User Accounts and Subscriptions
To access certain premium features of the Site, including our high-resolution archival databases and member directories, you may be required to register for a member account and maintain an active paid subscription plan. You agree to: (1) provide accurate, current, and complete information during registration; (2) maintain the security of your password and accept all risks of unauthorized access to your account; and (3) promptly notify us if you discover or suspect any security breaches related to the Site or your account. We reserve the right to modify, suspend, or terminate subscription tiers, pricing packages, or platform access permissions at any time at our sole discretion.
4. Forensic Analysis and Rating Services
We offer premium, on-demand paid services providing digital forensic analysis, historical mapping, and structured ratings of postal history covers (“Forensic Analysis Services”). Upon receiving full payment and a user-submitted high-resolution image scan of a postal cover, we will perform a specialized analysis. We will provide a structured forensic analysis sheet in a printable PDF format. This report will include a rarity assessment based on our proprietary 5-tier rarity system, calculated rate steps, postmarks, tracking paths, and relevant historical military or logistical contexts.
You are solely responsible for providing a clear, high-quality, high-resolution digital image scan of the cover to be evaluated. The accuracy, depth, and overall quality of our forensic analysis sheet are fundamentally dependent on the clarity and completeness of the image asset you provide. All payments must be processed in full prior to the evaluation and delivery of the report. All prices, including individual $7.99 single cover analysis options and subscription bundles, are listed in U.S. Dollars. The final structured analysis PDF will be delivered electronically to the email address associated with your account or through your secure member portal dashboard. We aim to process and deliver digital reports within our designated operational timeframes, but do not guarantee a definitive delivery timestamp due to the variable research requirements of historical artifacts.
5. Legal Disclaimer for Services
The structured ratings, tracking data, rate step breakdowns, and historical analyses provided by CoverCollect.co are intended for informational, educational, and historical research purposes only. The rarity assessments, scarcity scores, and narrative contexts are based on a comprehensive, localized analysis of publicly available data and independent philatelic research repository frameworks. The final report provided to you is explicitly NOT an official certificate of authenticity, a legal monetary appraisal, or financial investment advice.
We make no guarantees, express or implied, regarding the commercial market value, absolute authenticity, or future investment performance of any evaluated item. For legally binding authentication or formal financial valuations, you must consult a certified philatelic expert, legal appraiser, or formal certification board. You agree not to hold CoverCollect.co liable for any financial decisions, purchases, sales, or other actions you make based on our ratings, reports, or data sets.
6. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed, licensed, or approved by us. Prohibited activities include, but are not limited to: compiling data or content from our repository to create a competitive database; scraping data; bypassing security features; or using automated scripts to extract platform media.
7. Term and Termination
These Terms of Service shall remain in full force and effect while you use the Site or maintain an active subscription. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF SERVICE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES AND TERMINATING ACCOUNTS), TO ANY PERSON FOR ANY REASON OR FOR NO REASON.
8. Governing Law
These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the State of New York applicable to agreements made and to be entirely performed within the State of New York, without regard to its conflict of law principles.
9. Disclaimer of Warranties
THE SITE AND ITS PREMIUM RESEARCH REPOSITORIES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR ANALYSIS REPORTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
